TERM AND PAYMENT FOR SERVICES
1. If for any reason you are not satisfied with the Hosting Services provided, we offer a full money back promise. Simply cancel your Hosting Plan within the first thirty days of service and we will refund your money.
Privacy Police
2. BIRMADUU Web Hosting has a policy to respect and protect the privacy of its customers and their information that is stored with BIRMADUU. BIRMADUU will only access and disclose information as necessary to comply with applicable laws and government requests, to operate or maintain its systems or to protect itself or its customers. BIRMADUU will never sell customer data.
3. Birmaduu.com. ("BIRMADUU") provides various hosting services subject to the customer's compliance with the terms and conditions set forth in this policy. USE OF THE SERVICE CONSTITUTES AN UNDERSTANDING AND ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MUST NOT CONTINUE TO USE THE SERVICE. Violation of these terms may result in the suspension or termination of the services.
Terms of payment
4. This Agreement shall be for an "Initial Term" as chosen by you in the Order Form located on this Site at the time you register for the Services. This Agreement will be automatically renewed (the "Renewal Term") at the end of the Initial Term for the same period as the Initial Term unless you provide BIRMADUU Hosting with notice of termination thirty (30) days prior to the end of the Initial Term or the Renewal Term.
Termination Policy
5. You may cancel your web hosting account at anytime. Refunds for accounts cancelled after the first 30 days will be granted less the dollar amount for amount of time used as per the signup length of service. Any bandwidth overage will be deducted before refund is granted.
6. You are responsible for making sure that we have your current and correct contact information on file by advising BIRMADUU Hosting of any change relevant to billing. We reserve the right to send announcements and invoices relating your hosting account and domain name with us. No more than twice a month we may email you information on promotions or discounts relevant to your hosting or domain account with us. BIRMADUU Hosting will not give your email address or any other contact information to any third party except under the direction of law enforcement officials.
7. We will make every reasonable attempt to avoid unexpected server downtime and to ensure that all accounts are well taken care of. We cannot guarantee or predict server downtime. Any network problem or outage, is not covered under any guarantee or warranty and will not be grounds for reimbursement for any subsequent financial damages or losses. All account data backups are the account holder's responsibility. BIRMADUU Hosting is not responsible for your data backup or subsequent loss. Shared hosting accounts should not be used for mission critical websites or email that require absolute redundancy.
Charges
8. You agree to pay for all charges attributable to your use of the Services at the then current BIRMADUU Hosting prices, which shall be exclusive of any applicable taxes. You are responsible for the payment of all federal, state, and local sales, use, value added, excise, duty and any other taxes assessed with respect to the Services, other than taxes based on BIRMADUU Hosting's net income.
Payment
9. All charges for Services must be paid in advance according to the then current prices applicable to the Services. Upon entering this Agreement, you must choose to pay either by direct charge to a credit or debit card. If you choose to pay by credit or debit card upon registering for the Services, you thereby authorize BIRMADUU Hosting to charge your credit or debit card to pay for any charges that may apply to your account. You must notify BIRMADUU Hosting of any changes to your card account (including, without limitation, applicable account number or cancellation or expiration of the account), your billing address, or any information that may prohibit BIRMADUU Hosting from charging your account. BIRMADUU Hosting may also create periodic invoices for any applicable Supplemental Charges associated with your use of the Services. You agree to pay to BIRMADUU Hosting the amount indicated in each invoice by the due date reflected on that invoice. Failure to fully pay any fees and taxes within five (5) days after the applicable due date will be deemed a material breach of this Agreement, and BIRMADUU Hosting may, in addition to any other remedy it may have: (i) suspend its performance of the Services and/or terminate this Agreement; and/or (ii) At the time of such nonpayment, BIRMADUU may, delete any and all content from the BIRMADUU Servers. Any such suspension or termination of the Services would not relieve you from paying past due fees plus interest.
10. BIRMADUU reserves the right to modify these terms at any time. The customer's continued use of the service shall be deemed to be an acceptance of the updated terms of use. Conversely, customer may reject the update terms by ceasing use of the service.
Use of Website
11. It is the customer's responsibility to provide and maintain accurate contact information.
12. The registered owner of an account is responsible for the actions of all parties using that account.
13. Acceptable use: customer is expected to exhibit good netiquette. Example violations would be: illegal content or behavior, abusive content or behavior, sending of SPAM.
14. Adult content is not permitted.
15. Any attempt to reduce the security, stability, or integrity of BIRMADUU's systems, or those of any other organization, will result in immediate account termination and the notification of the relevant authorities.
16. The customer is responsible for maintaining backups of their site content.
17. The service is provided on an "as is" and "as available" basis without warranties of any kind, either expressed or implied. No advice or information given by BIRMADUU shall create a warranty. The only exception to this shall be that BIRMADUU will not charge its fixed monthly hosting fees if the hosting service is not available for 99.9% of the given month, and the fault is directly caused by equipment operated by BIRMADUU, or a mistake made by BIRMADUU.
18. Under no circumstances shall BIRMADUU be liable for any loss, damage, liability or expense incurred or suffered which is claimed to result from use of or inability to use the service, or the customer's reliance on or use of information services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, errors, delays, defects, or any failure of performance.
19. BIRMADUU's failure to enforce any term or condition in this policy shall not be taken as a waiver of that term or condition.
20. BIRMADUU reserves the right to send email notices to the customer.
21. BIRMADUU will have the final say on what constitutes a violation of these terms and conditions.
